This application was heard before the Nova Scotia Utility and Review Board ("NSUARB"), and it was previously heard in Bear Paw Pipeline Corporation Inc. (Re), 2016 NSUARB 139.
In this application, a series of permits were granted to Bear Paw Pipeline Corporation Inc. ("Bear Paw"), allowing the corporation to undertake the construction of a pipeline and related facilities. As part of the permits, Bear Paw was required to follow all relevant federal, provincial, and municipal laws, with particular attention paid to the Nova Scotia Pipeline Act and related regulations made under that Act. The applicant was also required to submit to the certifying authority all relevant information requested regarding the planning, construction, and testing of the pipeline. Bear Paw was also required to consult with the Native Council of Nova Scotia and report any threats that could arise from the pipeline for Indigenous harvesters, and to carry such insurance as the Board deemed appropriate. Finally, the permits were granted subject to the condition that if the applicant violated the terms set out in them, they could be suspended or terminated.
