This case was heard in the Small Claims Court of Nova Scotia.
After an oil leak on Mr. MacLean’s property contaminated Mr. Dow’s property, Mr. MacLean’s insurers arranged for Mr. Dow’s property to be cleaned up. Afterwards, Mr. Dow brought a claim for a number of additional expenses that he argued were the result of the contamination. After considering each claim individually, the Court rejected most of them; however, it held that Mr. Dow should be compensated for the costs of a home inspection and steam cleaning, in addition to his costs in court.
