This case was heard in the New Brunswick Court of Queen's Bench (Trial Division).

In the midst of an extended legal dispute between two defendants, Eastpre Feeds Ltd. and Marine Extract Ltd., and two branches of Irving Oil, the defendants asked the Court to add the Ville de Shippagan as a Defendant in the action and to initiate a case management process that would facilitate a more timely resolution of the dispute. The Court allowed the motion to include the Ville de Shippagan as a Defendant, but it held that additional case management was not yet necessary.
